Who can play
The Android and Windows versions are for players aged 13 and over. If you're under 18, or under the age of majority where you live, a parent or guardian must agree to these terms for you, and they're responsible for your purchases. On Roblox, Roblox's own age rules and parental controls also apply.
Our Privacy Policy explains how we handle your information, and is part of these terms.
Your licence
Hollow Porch Games ("we", "us") gives you a personal, limited, non-exclusive, non-transferable, revocable licence to install and play the game on devices you own or control, for your own non-commercial entertainment. You may not, and may not help anyone else to:
- copy, sell, rent, redistribute or sublicense the game or any part of it;
- reverse engineer, decompile, modify or create derivative works of the game, except where the law expressly allows it;
- use cheats, hacks, bots, modified copies of the game or any unauthorised software that changes or automates the game;
- exploit bugs or glitches to gain an advantage, and especially to harm other players' experience; please report them to us instead;
- interfere with the game, its servers or other players' connections, or try to get around bans or other restrictions.
Streaming, recording and sharing videos and screenshots of the game is welcome, including monetised videos, as long as you don't suggest that we endorse you.
In-game items and currency
The game has virtual items such as cash, diamonds, weapons, attachments, skins, gadgets, survivors and packs ("virtual items"). Virtual items:
- are licensed to you as part of your licence to play, and are not owned by you or property;
- have no real-world money value, can't be exchanged for real money, and can't be sold, traded or transferred outside the game;
- may be changed, rebalanced or removed as we update the game. If we remove a paid item for good, we'll give you a reasonable in-game replacement where we can.
Your progress is saved on your device (and, on Android, in your Google account if you use cloud saves). Uninstalling the game, clearing its data or using Delete My Data can permanently remove progress and virtual items. Permanent purchases (Remove Ads, VIP and the 4th weapon slot) can be restored with Restore Purchases, but used-up purchases, such as diamonds that were already spent, can't be restored.
Purchases and refunds
In-app purchases are optional. They're sold and processed by the store you got the game from (Google Play, Roblox, and Apple or Steam if the game is released there) under that store's terms, prices and payment methods. Prices are shown in the game before you buy and may include tax.
- Refunds are handled by the store under its refund policy (for example Google Play refunds). Except where the law says otherwise, purchases are final.
- Digital content in the EEA and UK: by completing a purchase, you ask for the item to be delivered immediately and you acknowledge that you lose your right to withdraw once it is delivered.
- Chargebacks and refunded purchases: if a purchase is reversed, we may remove the related items.
- Problems: if a purchase didn't arrive, try Restore Purchases, then email us with the order number.
Ads
The free Android version shows ads. Reward ads are optional. Buying Remove Ads or VIP turns off all ads permanently for the store account you bought it with. Your ad choices are explained in our Privacy Policy.
Online play and conduct
Online co-op and PvP need an internet connection and use public relay servers. They may be slow, interrupted or unavailable at times, and we can't guarantee them. When you play online, you agree to:
- choose a username that isn't offensive, hateful, sexual, threatening, or impersonating another person, a staff member or Hollow Porch Games;
- not harass, threaten, bully, scam or discriminate against other players, including through usernames, quick chat or behaviour in a match;
- not cheat, use modified copies of the game, deliberately exploit bugs, or disrupt matches;
- not share anyone's personal information, including your own, in your username;
- follow the online rules shown in the game.
Reports, blocks and bans
You can block and report players in the game. We review reports and may, at our discretion and without notice, warn players or ban their Player ID from online play temporarily or permanently. A ban doesn't stop offline play and doesn't entitle anyone to a refund, except where the law requires it. If you think we got it wrong, email us with your Player ID and we'll take another look.
Usernames and feedback
You're responsible for the username you choose and anything you send us. If you send ideas or feedback, you allow us to use them to improve the game without paying you or crediting you. Please don't send us anything confidential.
Our rights
The game, including its code, art, characters, music, sounds, names and logos, belongs to Hollow Porch Games or its licensors and is protected by copyright, trademark and other laws. These terms don't give you any rights in it beyond your licence to play. Open-source components are used under their own licences, listed in Settings > About > Licences.
If you believe something in the game infringes your rights, email us with the details and we'll look into it promptly.
Updates and availability
We may update, change, pause or discontinue the game or any part of it, including online play, at any time. Some updates may be required to keep playing online. We'll try to give reasonable notice of major changes, such as shutting down online play.
Store terms
Your use of the game is also subject to the terms of the store or platform you got it from: the Google Play Terms of Service, the Roblox Terms of Use, the Steam Subscriber Agreement or the Apple Media Services Terms. If they conflict with these terms about the store's own services, the store's terms apply.
If you got the game from Apple's App Store
These terms are between you and Hollow Porch Games only, not Apple. Hollow Porch Games, not Apple, is solely responsible for the game and its content. Your licence is limited to use on Apple devices you own or control, as allowed by the Usage Rules in the Apple Media Services Terms. Apple has no obligation to provide maintenance or support for the game. If the game fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation for the game. Apple is not responsible for addressing any claims by you or any third party relating to the game, including product liability claims, claims that the game fails to meet any legal or regulatory requirement, and consumer protection or similar claims, or for investigating, defending, settling or discharging any claim that the game infringes a third party's intellectual property rights. You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
No warranty
To the extent the law allows, the game is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise that the game will be error-free, uninterrupted, or compatible with every device, or that your progress will never be lost.
Limitation of liability
To the extent the law allows, Hollow Porch Games is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost progress, data, profits or virtual items, arising from the game or these terms. Our total liability for any claim is limited to the amount you paid us for the game and in-app purchases in the 12 months before the claim, or US$50, whichever is greater.
Nothing in these terms limits liability that can't be limited by law, such as for death or personal injury caused by negligence, or for fraud. If you live in the EEA, the UK or another country with mandatory consumer protection, you keep all the rights those laws give you, and these terms don't take them away.
Ending these terms
You can stop playing at any time by uninstalling the game. We may suspend or end your access to online play, or your licence, if you seriously or repeatedly break these terms. The sections about virtual items, our rights, the warranty, liability and governing law continue to apply after these terms end.
Governing law and disputes
These terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules, and disputes will be handled by the state or federal courts located in California. If you live in the EEA, the UK or another country whose laws give you the right to bring a claim in your own courts under your own laws, you keep that right. Before starting any claim, please email us so we can try to sort it out informally first; most issues can be solved that way.
General
- Changes to these terms: we may update these terms. We'll change the effective date above and, for significant changes, tell players in the game before they take effect. If you keep playing after that, you accept the new terms.
- Whole agreement: these terms and the Privacy Policy are the whole agreement between you and us about the game.
- Severability: if part of these terms can't be enforced, the rest still applies.
- No waiver: if we don't enforce a term straight away, we can still enforce it later.
- Transfer: you can't transfer these terms. We can transfer them to a company that takes over the game, and your rights won't be reduced.
